Rechtsgrundlage: Art. 6 Abs. 1 lit. c i. V. m.

10. Übermittlung in Drittländer

  • Berichtigung unrichtiger Daten (Art. 16 DSGVO),

So machen Sie Ihre Rechte geltend: Schreiben Sie an fhelleckes@gmail.com.

2. Summary

  • No account: you do not need to register or provide any contact details.
  • Your progress stays on your device: progress, settings and purchase status are stored locally only. We do not run our own servers and do not receive this data.
  • Ads only when you choose: ad videos (Google AdMob) are shown only when you actively start a video to earn a reward. In the EEA, the UK and Switzerland, personalized ads are shown only with your consent, which you can change in the App at any time.
  • Purchases: in-app purchases are processed by Google Play or the Apple App Store. The App asks the respective store directly on your device whether you own an item, and the purchase status is stored locally only. We never receive your payment details, and the App does not send any purchase data to us or other third parties.
  • No analytics tools: we do not use any analytics, crash-reporting or tracking services of our own, and we do not sell data.

3. No account, no registration

The App can be used entirely without a user account. We do not ask for your name, e-mail address or phone number. There are no cloud saves, no chat or social features, and no exchange of content between players.

4. Storage on your device

The App stores the following information only locally, in the App’s protected storage area on your device. It uses the system facilities SharedPreferences (Android) and NSUserDefaults (iOS) through the Flutter plugin “shared_preferences”:

  • game progress (e.g. souls, skill tree, unlocked weapons, codex entries, statistics, tutorial status),
  • settings (e.g. app language – German or English –, volume, screen shake, vibration, effects),
  • purchase status (VIP pass, cosmetic items), so that purchased content is also available offline (see section 9).

The App does not transmit this data to us or to third parties, and we have no access to it. In addition, Google’s User Messaging Platform described in section 6 stores your consent choice locally on your device.

Legal basis: the storage is strictly necessary to provide the game you requested (Sec. 25(2) no. 2 of the German TDDDG); where the GDPR applies, Art. 6(1)(b) GDPR.

Deletion: Settings › Reset progress deletes your game progress; purchases and settings are kept. To delete all local data, clear the App’s data in your system settings or uninstall the App. You can then recover purchased content via Shop › Restore purchases.

Device backups: depending on your device settings, your operating system may include app data in a backup (e.g. Android backup to your Google account, or an iCloud or device backup). This is done by your operating system or its provider under their terms, not by us.

5. Advertising with Google AdMob (rewarded videos)

5.1 Provider and how it works

To offer the game free of charge, we use the advertising service Google AdMob. For users in the European Economic Area (EEA) and Switzerland the provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; for all other users it is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (together “Google”).

The App shows rewarded videos only, and only when you actively tap a button to earn a reward (e.g. “Revive”, “Soul Saver” or “Reroll”). There are no banner or interstitial ads. With the VIP pass you receive these rewards without a video.

So that a video is available immediately when you want one, the Google Mobile Ads SDK is initialized when the App starts (after the consent check, see section 6) and preloads a video. The data listed below may therefore be transmitted to Google even if you never watch a video or own the VIP pass.

5.2 Data processed

According to Google, the SDK processes in particular:

  • the IP address, which may also be used to estimate your approximate location (e.g. country or city); precise GPS location is not requested,
  • advertising and device identifiers: on Android the advertising ID and the app set ID; on iOS the advertising identifier (IDFA) only with your permission (see section 7), as well as app- or vendor-scoped device identifiers (e.g. IDFV),
  • device and app information (e.g. device type, operating system and version, language, screen size, network type, app identifier and version),
  • interactions with the App and with ads (e.g. app launch, taps, video views, ads seen),
  • diagnostic and performance data (e.g. app launch time, hang rate, energy use) and, on iOS, crash logs that are not related to the user,
  • your consent choice (see section 6).

5.3 Purposes

Delivering the ad videos, frequency capping, measurement and billing (reach, performance), detecting and preventing fraud and abuse, security, and, only with your consent, personalized advertising based on your interests. According to Google, it also uses the data to provide and improve its services.

5.4 Legal bases

  • Personalized ads, and storing information on or reading it from your device (e.g. reading the advertising ID) where this is not strictly necessary: your consent (Art. 6(1)(a) GDPR, Sec. 25(1) TDDDG).
  • Non-personalized ads, measurement, frequency capping and fraud and abuse prevention: where consent is not obtained for these anyway, our legitimate interest (Art. 6(1)(f) GDPR) in financing the game through voluntarily watched ads and in preventing ad fraud.

If you do not consent, Google may serve non-personalized or “limited” ads. According to Google, limited ads do not use advertising identifiers or local storage for advertising purposes. The game remains fully playable in every case.

5.5 Google’s role and further information

Google processes this data as an independent controller (Google Ads Controller-Controller Data Protection Terms). For more information see Google’s Privacy Policy and “How Google uses information from sites or apps that use our services”. You can manage your Google ad settings at myadcenter.google.com. For transfers to the USA see section 10, for retention see section 15.

6. Consent and privacy options (Google User Messaging Platform)

To obtain and manage your consent we use Google’s User Messaging Platform (UMP). It is a consent management platform certified by Google and works under IAB Europe’s Transparency & Consent Framework (TCF).

  • Each time the App starts, the UMP asks Google whether a consent request is required in your region. In doing so, your IP address and device and app information are transmitted to Google.
  • In the EEA, the UK and Switzerland a dialog appears on first launch. You can consent, decline, or adjust your choices by purpose and vendor.
  • Your choice is stored locally on your device (the so-called TC string, in entries prefixed “IABTCF_”) and respected by the ads SDK.
  • In other regions, different notices or choices may be shown depending on local law.

Legal basis: Art. 6(1)(c) in conjunction with Art. 7(1) GDPR (demonstrating consent) and Art. 6(1)(f) GDPR (legitimate interest in legally compliant, user-friendly consent management). Storing your choice locally is permitted under Sec. 25(2) no. 2 TDDDG.

Changing or withdrawing your consent

In the App, open main menu › gear icon (Settings) › Privacy options. The button is shown when consent is required in your region. Withdrawal takes effect for the future; it does not affect the lawfulness of processing carried out before. Alternatively, clear the App’s data; the consent dialog will then appear again on the next launch.

7. Advertising ID and App Tracking Transparency

Android: the App contains the advertising ID permission (com.google.android.gms.permission.AD_ID) added by the Google SDK. You can reset or delete your advertising ID at any time in the Android settings (depending on the device under Settings › Google › All services › Ads or Settings › Privacy › Ads). After deletion, apps receive a string of zeros instead of your advertising ID.

iOS: the advertising identifier (IDFA) can only be used after you have expressly allowed it in the system’s “App Tracking Transparency” (ATT) dialog. Without your permission, the IDFA is not accessible to the App or to Google. The App remains fully playable, and rewards do not depend on your choice. You can change your choice at any time under Settings › Privacy & Security › Tracking. ATT permission does not replace consent under section 6: in the EEA, the UK and Switzerland, personalized ads require both.

8. In-app purchases via Google Play and the Apple App Store

The App offers optional one-time purchases (the VIP pass and purely cosmetic items, no subscriptions). Purchase and payment are handled under their own responsibility by Google (Google Play) or Apple (App Store; for users in Europe, Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland). You enter your payment details only with them; we never receive them.

Section 9 describes how the App determines which content you have purchased. As the provider, we only receive sales and payout reports from Google or Apple (e.g. order number, product, time, price and currency, country). We use them for accounting, to meet tax obligations and to handle support requests about a purchase.

Legal basis: Art. 6(1)(b) GDPR (performance of the purchase contract); for retaining accounting records Art. 6(1)(c) GDPR (retention obligations under commercial and tax law). Information on processing by the stores: Google, Apple.

9. Unlocking purchased content

The App checks whether you have purchased an item directly with Google Play or the Apple App Store. It does so through the respective store’s purchase interface on your device (Google Play Billing or Apple StoreKit, integrated via the official Flutter plugin “in_app_purchase”). No server of our own and no other service provider is involved.

  • After a purchase, the store tells the App on your device which product you have bought. The App unlocks the item and stores the purchase status locally (see section 4).
  • Shop › Restore purchases asks the store which items belong to your Google or Apple account and unlocks them again, e.g. after reinstalling the App or on a new device.
  • The App does not send any purchase data to us or to other third parties. Communication takes place only between your device and Google or Apple, which process the data under their own responsibility (see section 8).

Legal basis: Art. 6(1)(b) GDPR (performance of the purchase contract, delivering and restoring purchased content); storing the purchase status locally is permitted under Sec. 25(2) no. 2 TDDDG.

10. Transfers to third countries

  • Google: Google LLC is certified under the EU-U.S. Data Privacy Framework (DPF), including the UK Extension and the Swiss-U.S. DPF. Transfers to Google LLC are based on the European Commission’s adequacy decision of 10 July 2023 (Art. 45 GDPR) and, where necessary, additionally on standard contractual clauses (Art. 46(2)(c) GDPR).
  • Apple and Google Play: transfers in connection with purchases are governed by Apple’s and Google’s privacy policies.

Despite these safeguards, it cannot be ruled out that US authorities access data under US law.

11. No analytics or tracking tools of our own

The App contains no analytics, statistics or crash-reporting tools (such as Google Analytics for Firebase or Crashlytics) and no social media plugins. We do not build user profiles and do not sell personal data. This does not affect the processing by Google for advertising described in section 5.

12. App permissions

The App needs access to the internet and the network state (for ads and purchases). On Android, the bundled Google SDKs add permissions for the advertising ID, for the advertising APIs of the Android Privacy Sandbox, and for billing through Google Play. The App does not access your location (GPS), camera, microphone, contacts, photos or files. Vibration uses the system’s haptic feedback and can be switched off in the settings.

13. Contact by e-mail

If you contact us by e-mail, we process your e-mail address, your name if provided, and the content of your message in order to handle your request. The legal basis is Art. 6(1)(b) GDPR if your request relates to a contract (e.g. a purchase), otherwise Art. 6(1)(f) GDPR (legitimate interest in answering requests). Our mailbox is provided by Google (Gmail), so e-mails are also stored on Google’s servers, possibly in the USA (see section 10). We delete your messages once your request has been resolved, unless statutory retention obligations apply.

14. Children and teenagers

The App is not directed at children under 16. We do not knowingly collect personal data from children under 16. Persons under 16 may consent to personalized advertising only with the approval of their parents or guardians (Art. 8 GDPR; the age limit is 16 in Germany and between 13 and 16 in other EU countries). If you are a parent or guardian and find that your child has consented without your approval, you can withdraw the consent via the privacy options or contact us. We will then help you withdraw the consent and delete any data we hold.

15. Retention

  • Local data on your device: until you reset your progress, clear the App’s data or uninstall the App.
  • Consent status: stored locally on your device until you change it or clear the App’s data; Google may show the consent dialog again at regular intervals.
  • Google AdMob: Google determines retention under its own responsibility. According to Google, it anonymizes advertising data in server logs by removing part of the IP address after 9 months and cookie information after 18 months.
  • Google Play and Apple: according to the respective provider’s rules, including their statutory retention obligations. Your purchases remain associated with your Google or Apple account and can therefore be restored at any time.
  • Sales and payout reports from the stores (section 8): for the duration of the statutory retention obligations under commercial and tax law.
  • E-mails: until your request is resolved; beyond that only where statutory retention obligations (e.g. under commercial or tax law) apply.

16. Your rights

Under the GDPR you have the following rights:

  • access to the data we process (Art. 15 GDPR),
  • rectification of inaccurate data (Art. 16 GDPR),
  • erasure (Art. 17 GDPR),
  • restriction of processing (Art. 18 GDPR),
  • data portability (Art. 20 GDPR),
  • objection to processing (Art. 21 GDPR, see below),
  • withdrawal of consent with effect for the future (Art. 7(3) GDPR), e.g. via the privacy options in the App,
  • complaint to a supervisory authority (Art. 77 GDPR, see section 17).

Right to object under Art. 21 GDPR

Where we process data on the basis of Art. 6(1)(f) GDPR (legitimate interest), you may object to this processing at any time on grounds relating to your particular situation. Where data is processed for direct marketing purposes, you may object at any time without giving reasons. The easiest way is to not watch ad videos and to adjust the privacy options or your device’s advertising ID settings; you can also send us your objection informally by e-mail.

How to exercise your rights: write to fhelleckes@gmail.com. Because the App works without an account and we do not run any servers of our own, we usually hold no data that we could link to you (Art. 11 GDPR). You can delete the data in the App yourself as described in section 4. Your purchases are managed by Google or Apple through your Google or Apple account; you can exercise your rights regarding this purchase data directly with Google or Apple. For questions about a purchase, please give us the order number from your purchase confirmation so that we can find the transaction in our sales reports. We cannot delete data that Google processes as an independent controller for advertising ourselves. You can also exercise these rights directly with Google (see section 5.5).

17. Right to lodge a complaint with a supervisory authority

You have the right to lodge a complaint with a data protection supervisory authority, in particular in the member state of your habitual residence, place of work or place of the alleged infringement (Art. 77 GDPR). A list of supervisory authorities in the EEA is available from the European Data Protection Board.

The supervisory authority competent for us is: Die Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen (LDI NRW; State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia), Kavalleriestraße 2–4, 40213 Düsseldorf, Germany, www.ldi.nrw.de.

18. Security

All connections from the bundled services to Google and the app stores are encrypted with TLS. Local data is kept in the App’s protected storage area, which other apps cannot access. We take appropriate technical and organizational measures to protect your data. However, no one can guarantee absolutely secure transmission over the internet.

19. Provision of data, no automated decisions

You are under no legal or contractual obligation to provide us with personal data. Without consent, the App remains fully playable; if you start a rewarded video, you may then see non-personalized or limited ads. Without the data required for purchases, in-app purchases cannot be processed. There is no automated decision-making that produces legal effects concerning you or similarly significantly affects you (Art. 22 GDPR).

20. Changes to this policy

We update this privacy policy when the App, the services used or the legal situation change. The version published on this page applies.
